Trademark

The essential function of the trademark is to distinguish your product from the product of other companies. It serves as the badge that indicates that product belongs to which company. A trademark or service mark prevents another person from offering a similar product or service confusingly similar to yours. If you don't register your trademark, you may be prohibited from using it by someone who has.

Trademark constitutes of a word or a combination of words, letters, and numerals but they may also consist of drawings, symbols, three-dimensional features such as the shape and packaging of goods, non-visible signs such as sounds or fragrances, or color shades used as distinguishing features – the possibilities are almost limitless.

Different goods and services have been classified by the International (Nice) Classification of Goods and Services into 45 Trademark Classes (1 to 34 cover goods, and 35 to 45 cover services). The idea behind this system is to specify and limit the extension of the intellectual property right by determining which goods or services are covered by the mark, and to unify classification systems around the world.

For the territorial trademark protection, apply for trademark registration in that territorial trademark office. On the approval, pay the required fees. If want to register the trademark internationally register at each office or use WIPO (World Intellectual Property Organization).

It takes about 4 to 8 months for registration of trademark. The term of trademark registration can vary but is usually ten years. It can be renewed indefinitely on payment of additional fees. Trademark rights are private rights and protection is enforced through court orders.
